Boyle Chua disqualified two
years

Trainer Boyle Chua, who was disqualified one year each on three charges brought against him earlier, failed in his appeal and was given an additional one year on one of the charges when the Racing Stewards heard his appeal on Thursday. However, they ordered that the penalties are to be served concurrently instead of consecutively which means he will be disqualified only two years instead of the earlier three years. He was given a period of two weeks to wind up his stable operations at Kranji. On 2 September 2003, Chua was found guilty of charges brought against him under MRA Rules of Racing 203(c)(i), 203(c)(ii) and 53.(b)(i) of the Malayan Racing Association relating to a report from a certified polygraph examiner dated 18 July 2003 that Chua has made admissions to him in regard to having injected his horses, including BLUE MAX, with Equigen whilst in the Singapore Turf Club. The particulars of the charges were: 1. That he, a Trainer licensed by the Malayan Racing Association, is charged that he, between the period from 1 June 2002 to 17 July 2003, did have in his possession whilst on premises owned, used or controlled by the Singapore Turf Club including its race course stables means for the parenteral or nasogastric administration of a prohibited substance, to wit, that he had in his possession one or more hypodermic needles and / or syringes whilst on the premises of the Singapore Turf Club and he has thereby committed an offence under Rule 203(c)(i) of the Rules of Racing of the Malayan Racing Association; 2. That he, a Trainer licensed by the Malayan Racing Association, is charged that he, between the period from 1 June 2002 to 17 July 2003, did have in his possession whilst on premises owned, used or controlled by the Singapore Turf Club including its race course stables, a prohibited substance as defined in the Rules of Racing of the Malayan Racing Association, to wit, that he had in his possession the prohibited substance known as Equigen whilst on the premises of the Singapore Turf Club and he has thereby committed an offence under Rule 203(c)(ii) of the Rules of Racing of the Malayan Racing Association; and 3. That he, a Trainer licensed by the Malayan Racing Association, is charged that he, between the period from 1 June 2002 to 17 July 2003, whilst being a person licensed or registered by the Malayan Racing Association, he committed an act of misconduct, to wit, that he, whilst a licensed Trainer of the Malayan Racing Association, administered the prohibited substance known as Equigen to a horse using a hypodermic needle and syringe whilst on the premises of the Singapore Turf Club when he knew that it was an offence to do so and he has thereby committed an offence under Rule 53.(b)(i) of the Rules of Racing of the Malayan Racing Association. Chua was disqualified for a period of one year under each charge with immediate effect and the penalties are to be served consecutively. He was advised of his right of appeal. He was also advised that should he decide not to appeal, he would be given until 23 September 2003 to wind up his stable operations. On 3 September 2003, Trainer Chua exercised his right of appeal against the decision of the Stipendiary Stewards and the penalties imposed on him. On application, he was granted a stay of sentence. The Race Meeting Stewards’ Hearing of the Appeal was concluded on Thursday, 30 October 2003. According the Stipendiary Stewards' report issued last night: "After considering all of the evidence together with submissions from Trainer Chua’s Counsel and the Inquiry Panel’s Counsel, the Race Meeting Stewards dismissed the Appeal on all the charges and confirmed the penalty of a year’s disqualification each for the first and second charges. In respect to the third charge, the Stewards increased the penalty to a disqualification of two years. All three penalties are to be served concurrently. The penalties will take effect from Saturday, 1 November 2003 and he was given a period of two weeks to wind up his stable operations. His deposit was forfeited. |
