Double trouble for trainer

Trainer Hoy Kee Poh was fined RM15,000 under
MRA Rule 203(b) on Monday when the Stewards concluded an inquiry into POWER
HERO being tested positive to Clanobutin at Ipoh on June 6.
At the same time, the Stewards also began an inquiry into his training activities which was adjourned to a date to be fixed. In the meanwhile, they ordered that his track rider Christopher Innes not be permitted to enter Hoy’s stables until the matter is concluded and several horses may not race until such time as they are satisfied to the bona fides of the trainer. POWER HERO, who finished fourth to THAI BOXER in a Maiden, Div 2 - 1,600m handicap, has been disqualified from the race but is cleared to race. The following is the Stipe’s Report issued after Monday's inquiry: Race 2, Sunday, 4th Day, 6 June 2004, Perak May/June Meeting The Stewards today inquired into the Analyst’s report of the prohibited substance, Clanobutin being detected in the urine sample take from the gelding POWER HERO following its 4th placing in Rae 2 at the Perak Turf Club’s meeting on 5 June 2004. Evidence was taken from licenced trainer KP Hoy, Professor Tan Soo Choon, Chief Analyst of Veterinary Forensic Laboratory, and Dr KM Rajagopal, Senior Veterinary Surgeon, PRTC assisted the inquiry. Dr Rajagopal gave evidence that Clanobutin acts on the digestive system and improves the appetite of the horse. Also, Professor Tan also provided evidence that the likely administration time in all probability of this case would be less than two days prior to the horse being sampled. KP Hoy was found guilty of a charge under MRA Rule 203(b), of having accepted for POWER HERO, which competed in the aforementioned race and that the urine sample taken from the gelding had detected in it a prohibited substance. After considering all the evidence, HP Hoy was fined the sum of RM15,000. The Stewards acting under MRA Rule 203, disqualified POWER HERO from its race and amended the placings to read: 1st - THAI BOXER (SH Lee) POWER HERO is cleared to race. Furthermore, the Stewards inquired into the training activities of KP Hoy. Evidence was taken from Hoy and licenced track rider Christopher W Innes. The Stewards adjourned the matter until a date to be fixed, however they directed that the following horses may not raced until such time as they are satisfied to the bona fides of the trainer. Hoy was directed that Christopher Innes is not permitted to enter his stables until the matter is concluded: GOLDEN ENERGY, POWER HERO, WONDERFUL DRAGON, KISS OF DRAGON, CITY EMPEROR, JERAM FIGHTER, JERAM MAS, GOLDEN HUNTER, POWER OF GOLD, KUALA DIPANG and JERAM. Post-Race Urine, 5 & 6 June 2004, Perak May/June Meeting The Stewards today (Monday, 28 June 2004) conducted an inquiry into the Analyst’s report that urine sample taken from app A Kumarentheran on the 5th June 2004 at the PRTC Meeting contained a prohibited substance, Opiates (Codeine). Evidence were taken from app Kumarentheran, his master, PK Leong, app H Barnabas and his master, KP Hoy. Professor Tan Soo Choon, Chief Analyst of Veterinary Forensic Laboratory assisted the inquiry. The Stewards were comfortably satisfied, that on the evidence app Kumarentheran had, after riding in Race 3 suffered from a back complaint and sought some medication to alleviate this which he took from Henry Barnabas’ race day bag without his knowledge. Such medication being the registered pharmaceutical product "Nurofen Plus" which contained codeine and was purchased by Henry Barnabas during a recent visit to Australia. App A Kumarentheran pleaded guilty to a charge under MRA Rule 204(3)(ii) in that he on the aforementioned day, delivered a sample of his urine which had detected in it a prohibited substance. He was suspended from riding in races for a period of one (1) month to commence from 15 June 2004. Further, app A Kumar pleaded guilty to a charge of negligence under MRA Rule 53(b)(i) in that he failed to declare on the prescribed document, TESTING OF RIDERS FOR BANNED SUBSTANCES, that he had taken medication during the last seven days. He was fined the sum of RM1,000. Race 8, 4th Day, Sunday, 27 June 2004 App WK Yan (LABU LABU) today (Monday, 28 June 2004) pleaded guilty to a charge of careless riding under MRA Rule 149(a)(ii) in that near the 1800m, he allowed his mount to shift in on an acute angle, causing SIMPLY NOBLE to lose its rightful running and to be steadied. App Yan’s licence to ride in races was suspended for a period of four (4) days, effective today, 28 June 2004 and to expire on 11 July 2004, on which day he may resume riding. Race 9, 4th Day, Sunday, 27 June 2004 When questioned regarding the disappointing performance of MR MAJESTIC, trainer W Yeo explained that as mentioned by its rider, I Azhar, the gelding appeared tired and attributed this factor to MR MAJESTIC having had a hard campaign. He added that this may be indicative of the weight loss of 13kgs from its last start and he will now give the gelding a let up. Appeal of Racehorse Owner Khoo Hock Eng against the Three Years Disqualification Imposed by the Stipendiary Stewards under MRA Rule 234(D)(ii) for Conduct Prejudicial to the Integrity of Racing in that he had a wager with an illegal bookmaker relative to the running of MEYER CAN CAN in Race 3, 31 May 2003, 1st Day, Perak May/June Meeting 2003 The Race Meeting Stewards today, Monday, 28 June 2004, heard the above-mentioned appeal. After considering all the evidence including submissions form Mr Khoo, his defence counsel and the Chief Stipendiary Steward, the Race Meeting Stewards dismissed the appeal. However they reduced his sentence from three years to two years and that his two-year disqualification to take effect from 15 September 2003. They further ordered his deposit be refunded. |
