Graham Jordan's disqualification reduced

Australian trainer Graham Jordan, who was disqualified a total of 11 years on six charges in relation with the running of MEYER CAN CAN here on 31 May last year, won his appeal on two of six charges yesterday.

But more importantly, the Perak Turf Club Racing Stewards ordered that Jordan’s sentences to run concurrently, instead of consecutively previously, which means that Jordan will be sidelined for only three years. His three-year disqualification takes effect from 19 September 2003. (He was denied a stay of execution of his sentences.)

The Race Meeting Stewards of the Perak Turf Club yesterday heard the following appeals:

1. The first charge being under MRA Rule 200 Sub-Rule (1) in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) prior to the race, committed a corrupt practice in that he offered jockey Marcus Au, the rider of the horse MEYER CAN CAN in the said race, money present to wit, tickets, to stop the horse from winning the race or to prevent the horse from winning the race. On this charge, Jordan was disqualified from racing for a period of three years.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards dismissed his appeal and confirmed the three-year disqualification.

2. The second charge being under MRA Rule 144 Sub-Rule (3) in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) prior to the race, instructed jockey Marcus Au, the rider of the horse MEYER CAN CAN in the said race, to stop the horse from winning the race or to prevent the horse from winning the race. On this charge, Jordan was disqualified from racing for a period of two years.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards dismissed his appeal and confirmed the two-year disqualification.

3. The third charge being under MRA Rule 53(b)(i) in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in

Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) at about 1:00 pm on 2 July 2003, prior to the inquiry by the Panel of Stipendiary Stewards on the complaint by Owner, Mr Khoo Hock Eng against him, scheduled for the 3rd July 2003, committed misconduct, in that he threatened jockey Marcus Au, the rider of the horse MEYER CAN CAN in the said race, whom he knew would be a witness at the inquiry, to wit, that if he told the truth at the inquiry that he (G F Jordan) would go after him. On this charge, Jordan was disqualified from racing for a period of three years.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards dismissed his appeal and confirmed the three-year disqualification.

4. The fourth charge being a contravention of Regulation 37.1(a)(ii) of the Rules of Racing of the Malayan Racing Association in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) prior to the race, failed to report to the Stewards an attempted malpractice which may compromise the integrity of racing, to wit, ha received a telephone call on the morning of 31 May 2003 from a person known to him to be either connected or having connections with illegal bookmakers, who offered him tickets to stop the horse or to prevent the horse from winning the race. On this charge, Jordan was disqualified from racing for a period of one year.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards upheld his appeal.

5. The fifth charge being a contravention of Regulation 37.1 (a)(i) of the Rules of Racing

of the Malayan Racing Association in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) prior to the race, provided information to wit, the winning chances of the horse MEYER CAN CAN in the aforementioned race to a person known to him to be either connected with or having connections with illegal bookmakers or persons whose conduct, character, or reputation indicated that he may pose a threat to the integrity of racing. On this charge, Jordan was disqualified from racing for a period of one year.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards upheld his appeal.

6. The sixth charge being under MRA Rule 53(b)(i) of the Rules of Racing of the Malayan Racing Association in that trainer G F Jordan, licensed by the Malayan Racing Association, the trainer of the horse MEYER CAN CAN which ran in Race 3, at the Perak Turf Club on 31 May 2003 (1st Day, Perak May/June Meeting 2003) in the course of the inquiry before the Panel of Stipendiary Stewards on the complaint by Owner, Mr Khoo Hock Eng against him. On 3 July 2003 committed misconduct, in that he stated in evidence that he did not telephone Mr Khoo Hock Eng on two occasions before the race which statement he either knew or believed to be false, of did not believe to be true. On this charge, Jordan was disqualified from racing for a period of one year.

After considering all the evidence including submissions from Jordan, his witness and the Chief Stipendiary Steward, the Race Meeting Stewards dismissed his appeal and confirmed the one-year disqualification.

The Race Meeting Stewards ordered that Jordan’s sentences to run concurrently and that his three-year disqualification take effect from 15 September 2003. They further ordered his deposit to be refunded.
