Yeap disqualified seven
years on appeal

Penang trainer Yeap Poh Keat’s will serve
seven years of his original nine-year disqualification following an appeal
by the former jockey here yesterday.
Yeap was found guilty of six charges but on two charges, his disqualification was reduced by one year each. The Stipendiary Stewards’ report issued today is as follows: APPEAL BY P K YEAP AGAINST THE SEVERITY OF THE NINE YEARS DISQUALIFICATION UNDER MRA RULES 45(a), 203(b), 203(c)(i), 234(F), 200(12), AND THE CONVICTION UNDER RULE 200(5), IMPOSED ON THE 7 JANUARY 2004. The Race Meeting Stewards of the Penang Turf Club on Monday, 12 July 2004 heard the appeal regarding the following charges, and after considering submissions form counsel representing P K Yeap and Chief Stipendiary Steward, made the subsequent rulings: 1. That P K Yeap was found guilty of a charge under MRA Rule 45(a) in that he permitted Paul Tan Peng Liong, a temporary syce, not being a holder of a trainer’s licence issued by the Malayan Racing Association, to train horses namely BE AHEAD, PRIVATE EQUITY, OLYMPIC STYLE, MEGA SUCCESS and I’M SPECTACULAR between 11 September 2003 and the 21 November 2003 at the racecourse of the Penang Turf Club which horses, were at all material times, under the charge of Yeap. Yeap was disqualified for a period of two (2) years. The Racing Stewards confirmed the penalty in respect of this charge. 2. That P K Yeap was found guilty of a charge under MRA Rule 200(5) in that on 1 November 2003 at about 4:25pm in the saddling area of the Penang Turf Club racecourse, he caused his Syce, Paul Tan to administer to the horse I’M SPECTACULAR fluid which contained a prohibited substance, namely Mefenamic Acid by means of nasogastric instrument to wit, a metal pressure infuser. He was disqualified for a period of two (2) years. The Racing Stewards dismissed the appeal against conviction in respect of this charge and confirmed the penalty. 3. That P K Yeap was found guilty of a charge under MRA Rule 203(b) in that the racehorse I’M SPECTACULAR which was accepted to run in Race 7 on 1 November 2003 at the Penang Turf Club Meeting, failed its post-race examination in that a urine sample taken from the horse showed the presence of the prohibited substance, namely Mefenamic Acid. He was disqualified for a period of two (2) years. The Racing Stewards reduced the disqualification of this charge to one year. 4. That P K Yeap was found guilty of a charge under MRA Rule 234(F) in that on 14 November 2003, at the inquiry of the Stipendiary Stewards in respect of the presence of Mefenamic Acid, a prohibited substance in the urine sample taken from the horse I’M SPECTACULAR which competed in the aforementioned race, brought Robert Savarimuthu, a syce temporary registered with the Penang Turf Club, to the inquiry to make a false statement to wit that he, Robert Savarimuthu administered a substance to I’M SPECTACULAR when in fact, he did not believe to be true in order to mislead the Stipendiary Stewards. Yeap was disqualified for a period of two (2) years. The Racing Stewards confirmed the penalty in respect of this charge. 5. That P K Yeap was found guilty of a joint charge under MRA Rule 200(12) in that he did during the month of September, conspired and agreed to a malpractice to wit, the employment of Paul Tan, not being a holder of a trainer’s licence issued by the Malayan Racing Association, by Mr Lim Kok Leong to train horses namely, BE AHEAD, PRIVATE EQUITY, OLYMPIC STYLE, MEGA SUCCESS and I’M SPECTACULAR between 11 September 2003 and 21 November 2003 at the course of the Penang Turf Club, which horses were at all material times under the charge of P K Yeap, a trainer licensed by the Malayan Racing Association and in pursuance of the agreement trained horses namely, BE AHEAD, PRIVATE EQUITY, OLYMPIC STYLE, MEGA SUCCESS and I’M SPECTACULAR. PK Yeap was disqualified for a period of two (2) years, which is to be served concurrently with the consecutive charge under MRA Rule 45(a). The Racing Stewards confirmed the penalty in respect of this charge. 6. That P K Yeap was found guilty of a joint charge under MRA Rule 200(12) in that on Thursday afternoon, 13 November 2003 he conspired and agreed to a fraudulent practice, to wit for Robert Savarimuthu, a syce temporarily registered with the Penang Turf Club, the syce of the racehorse I’M SPECTACULAR which ran in Race 7, at the Penang Turf Club on 1 November 2003, to give false evidence at the inquiry on 14 November 2003, to wit, that he administered a substance, not being a feed for horses, to the horse I’M SPECTACULAR, namely Mefenamic Acid, a prohibited substance in the urine sample taken from that horse. P K Yeap was disqualified for a period of three (3) years which is to be served concurrently with the consecutive charge under MRA Rule 234(F). The Racing Stewards reduced the disqualification in respect of this charge to two years. In total, Yeap will serve seven years disqualification, commencing from 7 January 2004. Yeap’s deposit was refunded. |
