Sainul Jumaat's appeal dismissed

SINGAPORE,  19 October 2005

Jockey Sainul Jumaat’s appeal against two-year disqualification has been dismissed and he will serve his time with effect from Sept 28, the day he was handed the sentence.

Sainul, who rode ASIAN CLASSIC (4 b.a.g Kenfair - Efflorence by Grosvenor) to fourth placing behind TAURUS in a Class 4, Div 1 - 1200m handicap on Sept 17, was found guilty by the Stipendiary Stewards to a charge under MRA Rule 144.(2) punishable under MRA Rule 144.(5) on Sept 28 in that despite being instructed to improve from the 600m and ride his mount out fully to the finish, he failed to take all reasonable and permissible measures to ensure that ASIAN CLASSIC was given full opportunity of winning or obtaining the best possible placing in the race. The particulars of the charge were that:

1. from near the 600m until near the 450m, he restrained his mount from going forward when there was an opportunity and it was reasonable to do so;

2. from near the 400m until near the 200m, he failed to ride with sufficient vigour and determination;

3. near the 200m, he restrained his mount inwards when there was an opportunity to take a run and improve to his outside; and

4. over the final 100m, he failed to ride with sufficient vigour and determination.

When deciding on penalty, the Stewards took into account the nature of the charge and his record.

On Sept 29, Sainul exercised his right of appeal against the decision of the Stipendiary Stewards and the penalty imposed on him. He also applied for a stay of sentence which was denied the following day.

The hearing of his appeal was concluded yesterday.

After considering all of the evidence together with submissions from Sainul’s counsel and the Chairman of the Inquiry Panel, the Race Meeting Stewards of the Singapore Turf Club dismissed the appeal. The penalty was confirmed and Sainul was disqualified for a period of two years. As a stay of sentence had not been granted pending the appeal, the Stewards decided that the disqualification will be effective from Sept 28. His deposit was forfeited.
