How Yang disqualified one year

How Yang has joined a long line of riders on the disqualification list.

The apprentice was hauled up for his handling of SUCCESS TYCOON in the Class 4, Div 1 - 1200m sprint last Saturday after the Happy Giggle gelding finished seventh to BANKER WAY.

At the conclusion of an inquiry today, after taking evidence from trainer MC Lam and reviewing the films, How Yang, in the presence of his master, trainer Evelyn Seet, was found guilty of a charge under MRA Rule 44(8) in that whist riding SUCCESS TYCOON in the above race, he failed to take all reasonable and permissible measures to ensure that SUCCESS TYCOON was given full opportunity of winning or of obtaining the best possible placing.

The particulars of the charge were that:
1. from the 650m to the 400m, he restrained his mount for no apparent reason, thereby resulting in his mount throwing its head on a few occasions and losing ground; and
2. from the 400m to the finish, he failed to urge his horse forward and continued to restrain his mount whilst using his whip ineffectively.

When deciding on penalty, the Stewards took into account How Yang’s previous clean record and the fact that he had limited race riding experience. After considering the provisions of MRA Rule 44(8)(a), How Yang was disqualified for a period of one year with immediate effect from today and to expire on September 13, 2008, both days inclusive. He was advised of his right of appeal.

In addition, after considering evidence from trainer MC Lam regarding this case, the matter was adjourned to a date to be fixed.

How Yang subsequently exercised his right of appeal against the decision and penalty, and applied for a stay of sentence, which was not granted. The appeal will be held on a date to be fixed.
