How Yang suspended 9 months on appeal

PENANG,  17 November 2007

How Yang, who was initially disqualified one year for his handling of SUCCESS TYCOON in the Class 4, Div 1 - 1200m sprint in Penang on Sept 8, has pleaded to an amended charge and suspended nine months.

SUCCESS TYCOON, since renamed SPEED THUNDER, finished seventh to BANKER WAY and How Yang was on Sept 14 found guilty of a charge under MRA Rule 44(8) in that whist riding SUCCESS TYCOON in the above race, he failed to take all reasonable and permissible measures to ensure that SUCCESS TYCOON was given full opportunity of winning or of obtaining the best possible placing.

How Yang subsequently exercised his right of appeal against the decision and penalty. His application for a stay of execution was not granted.

The Penang Turf Club Racing Stewards heard the above appeal yesterday.

After considering submissions from How Yang, trainer Evelyn Seet, trainer MC Lam, the owner of SUCCESS TYCOON, his Counsel and the Stipendiary Steward, and after considering all the evidence, the Racing Stewards amended the charge to MRA Rule 44(10) for failing to ride to the satisfaction of the Stewards. App How Yang pleaded guilty to the charge and the Racing Stewards, acting under MRA Rule 12(2)(z), suspended App How Yang’s licence from riding in races for a period of nine months from Sept 14 and to expire on June 13, 2008. How Yang’s deposit was forfeited.
