Tennent loses final appeal

Trainer Peter Tennent has lost his case in the Court Of Appeal in Malaysia against a one-year disqualification in the WONDERFUL GENERAL case. WONDERFUL GENERAL, trained by Tennent and ridden by David Miller, came from a long way back to finish sixth to ALWAYS AN ANGEL in a Class 2 - 1200m sprint in Penang on Oct 14, 2000. Tennent was charged on Oct 16, 2000 under MRA Rule 144(4) which states that "where any rider is found in breach of sub rule (2) of this rule, the trainer of the horse in question shall be deemed to be in breach of this rule unless the trainer satisfies the Stipendiary Stewarts that the rider failed to comply with the instructions given to him under sub (3) of this rule which if followed would have enabled the rider to have obtained the best possible placing, and in this event the trainer shall be found not to have be in breach of this rule." Tennent was disqualified one year and Racing Stewards threw out his appeal on Apr 28, 2001. Tennent was continued to train at Sungei Besi after taking out an court injunction against the Malayan Racing Association (MRA) on Dec 6, 2006. After the Court Of Appeals dismissed Tennent's appeal, the MRA said in a statement today, the "Erinford junction" that Tennent obtained against the MRA on Dec 6, 2006 was set aside (ceases to have any further effect) and the decision of the Racing Stewards made on Apr 28, 2001 was restored." Tennent's disqualification took effort from April 6 and will expire on Apr 5, 2010. He was given a period of two weeks to wind-up the business and transfer out the horses. |
