On 08 September 2015, Stewards were made aware that App R Shafiq’s mother-in-law was registered as an Owner on 9 April 2014.

An Application was received on 9 September from App Shafiq applying for exemption under MRA Rule 46(4) with regard to immediate family, as defined under the MRA Rules, owning horses.

App Shafiq’s application for exemption was considered and approved by the Singapore Turf Club Racing Sub-Committee on 15 September 2015. However, this exemption was only granted effective from 15 September 2015.

Subsequently, App Shafiq, in the presence of his Master, Trainer M Walker, was advised if he wished for an exemption to be granted retrospectively from 9 April 2014, he would be required to lodge an application specifically requesting for this exemption.

In addition, he was advised that under the provisions of MRA Rule 46(5) which states:

"(5) In any event, where an exemption has been granted, no Jockey shall ride for any other owner in a race in which any horse owned by that Jockey and/or that Jockey’s immediate family is entered."

even if he was granted a retrospective exemption, he would be required to attend an Inquiry with regard to three races between 09 April 2014 to 15 September 2015 in which he rode in and did not ride his mother-in-law’s horse, which she part owned and also ran in the same race.

An Application was received on 22 September 2015 from App Shafiq applying for a retrospective exemption from 9 April 2014 under MRA Rule 46(4) with regard to immediate family owning horses.

This Application was considered and approved by the Singapore Turf Club Racing Sub-Committee on 30 September 2015.

At the conclusion of an inquiry on Wednesday, 02 December 2015, App R Shafiq, in the presence of his master, Trainer M Walker, pleaded guilty to the following three charges under MRA Rule 46(5) in that:

(3) in Race 2 at the Singapore Turf Club Meeting on Sunday, 16 August 2015, he rode NOVA LEGEND and did not ride SPUR ME ON, which was part owned by his mother-in-law who is defined under the MRA Rules as immediate family

After considering submissions from App Shafiq and his master, Trainer Walker in regard to penalty and in addition after taking into account his guilty plea, the circumstance and nature of the charge, the Panel of Stewards determined the appropriate penalties to be:

On the first charge, App Shafiq was disqualified for a period of one month.

On the second charge, App Shafiq was disqualified for a period of one month.

On the third charge, App Shafiq was disqualified for a period of one month.

These three penalties will be served concurrently. However, these penalties were to take effect following the completion of App Shafiq’s current suspension for careless riding which is until 13 December 2015 inclusive.

As such, App Shafiq was disqualified from Monday, 14 December 2015 to Saturday, 13 January 2016 both dates inclusive (a period of one month). He was advised of his right of appeal.

In addition the Panel of Stewards determined acting under the provisions of MRA Rule 46 that:
